01What you're buying
A monthly marketing plan: Social, Social + Design, Growth, or Growth for two brands. What each plan includes is listed on the marketing page and on your first invoice. Everything listed is included in the monthly price. Nothing else is, unless we've agreed to it in writing.
Not included in any plan: paid advertising, website hosting, domain registration, email service, and license fees for premium themes or plugins we don't already hold. If you need paid ads, we'll tell you who to call.
The one-time setup
$750 for one brand, $1,200 for two. That builds your brand kit: templates, type, colors, and the photo treatment your posts use. Keeping the kit current is included every month after. The setup fee is due before we start and isn't refundable once the kit build has begun.
A large piece
The Social + Design and Growth plans include one large piece a month. A large piece is one of these: a web page, an email series of three or four, a lead magnet built and connected to your list, or an article structured so AI search has a reason to cite it. We size the work. You choose what it's for. If you ask for something bigger than a large piece, we'll quote it separately before starting.
Small edits
Small edits are unlimited. A small edit is a text or image change to something that already exists, about half an hour of work or less. Anything larger is a large piece or a quoted job.
A second brand
A second brand is a second workstream with its own kit, calendar, and report. That means two websites, or one company with a separately branded service. A landing page under your main brand is a large piece, not a second brand.
02How the month works
- Posts. Ten a month per brand, written, designed, scheduled, and published by us to the accounts you've connected. Reels are built from your own photographs.
- You approve everything before it goes live. We send the month's content for review. Nothing publishes without your approval.
- Two revision rounds on every piece. After the second round, further changes count as a small edit or, if larger, are quoted.
- Timelines start when we receive your files. Photos, logo, copy, logins. If we're waiting on you, the calendar waits too.
- Approvals within five business days. If we don't hear back, we hold the content and move on to the next month's work. Held content doesn't publish until you approve it.
- Unused work carries over one month, then expires. If a month's posts or large piece aren't used because we were waiting on you, they carry into the next month. After that they're gone.
- SEO and AEO pages (Growth plans) publish to your WordPress site after your approval. Two a month for Growth, two to four for two brands, depending on length.
03Getting in touch
Email is how we work: brent@gairy.co. Requests sent by text, DM, or social media can't be tracked, so we'll ask you to resend them by email. We reply within one business day, Monday through Friday, on Central time. We don't work weekends or U.S. holidays. Clients on a current plan come first in the queue, and the two-brand Growth plan is first in line.
04What we need from you
- Administrator access to your WordPress site, and to the social accounts we'll publish to.
- Access to Google Search Console, Google Analytics, and Google Business Profile. The monthly report is built from these. Without them, we can't write it.
- Photographs of your work, your place, your people. We'll tell you how many and what kind at setup. If you don't have a camera, your phone is fine.
- Your logo files, your colors if you have them, and any brand rules we should follow.
- A person who can approve content within five business days.
05Your photos, your claims
You confirm you have the right to use every photo, logo, and piece of text you send us, including permission from any person who appears in a photo. You confirm that what you approve for publishing is true. Once you approve something, you own the claim it makes.
If your business has rules about what it can say publicly, whether from a licensing board, a franchise, a regulator, or a law like HIPAA, it's your job to tell us those rules at setup. We'll follow them once we know them. We don't guarantee compliance with any rule we haven't agreed to in writing.
06Your website
Website upkeep means WordPress core, theme, and plugin updates applied weekly, a daily backup we keep for thirty days, and a security scan. If your site is compromised while on a plan, we restore it from backup or clean it at our discretion, at no charge for the first hour.
Hosting isn't ours. We aren't responsible for your host's speed, uptime, certificates, or billing. If a host problem needs fixing, that's billed at our current hourly rate.
Premium themes and plugins that need a paid license: if we hold the license, it's covered while you're on a plan. If we don't, keeping it licensed is yours, and we'll tell you which ones.
If an update breaks something, we sort it out. The first hour is on us. Beyond that it's hourly, and we'll tell you before we start. Work needed because someone else changed the site, whether a developer, a designer, or you, is billed hourly.
Email your site sends, like form notifications, is often filtered as spam by mail providers. We can't control that and aren't responsible for it. Check your form inbox.
07The report
Once a month you get a report on what we built, what got published, how you're showing up in search, and the numbers from Search Console, Analytics, and your social accounts. It's written in plain English and it's honest when a number is flat. We report what the tools say. We don't promise rankings, traffic, leads, or revenue, and nobody honest does.
08Money
- Billing. Monthly, in advance, on the day your plan started, by card on file. Setup is invoiced separately before the kit build.
- Month to month means what it says. Cancel any time with fifteen days' written notice. Your plan ends at the close of the billing period you've paid for. No refunds on months already billed.
- Twelve months gets the lower price on every plan in exchange for a twelve-month commitment. If you leave before the twelve months are up, we invoice the difference between the twelve-month price and the month-to-month price for every month you were on the plan. That's it. No payout of remaining months.
- Our current hourly rate applies to anything outside the plan. It's the rate in place when you ask for the work, and we'll quote it on request. As of this version it's $250 an hour, billed in half-hour increments.
- Late payment. If a card fails and isn't fixed within ten days, we pause the plan until it is. Invoices unpaid thirty days after the due date carry interest at 1.5 percent a month, and you agree to cover reasonable collection costs.
- Price changes. We can change plan prices with thirty days' written notice. A price change never applies inside a twelve-month term you've already started.
09Ending the plan
On your end date, scheduled posts stop. You keep every social account, your website, and your logins. Within fourteen days we hand over your brand kit files, source files for anything we made, and any content that's been paid for. After that, keeping the site updated and backed up is yours.
We can also end a plan, with thirty days' notice and a refund of anything prepaid past the end date, or immediately if you ask us to publish something false, unlawful, or abusive.
10Who owns what
Everything we make for you is yours once it's paid for: posts, pages, templates, the brand kit, the reports. Until it's paid for, it's ours. We keep the tools, processes, and templates we use across clients, and we use AI tools as part of how we work.
We may show work we've done for you in our portfolio and on our own marketing. If you'd rather we didn't, tell us in writing and we won't.
11The legal part
Warranty
We'll do the work to the standard of a competent professional in this field. Beyond that, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent the law allows us to exclude them. We can't guarantee our work will be error-free, and we aren't liable for damage caused by viruses, attacks, or other harmful material affecting servers, software, or data.
Limit on liability
Our total liability to you under this agreement, for any claim and on any theory, is limited to the fees you've paid us in the six months before the claim. We aren't liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost business, or lost data, even if we were told they were possible. Nothing here limits liability that can't be limited by law.
Indemnity
You'll defend and hold us harmless from claims and costs, including reasonable attorney's fees, that arise from content, photos, or claims you supplied or approved, from your breach of this agreement, or from your business's products and services. We'll do the same for you for claims that our own original work infringes someone's intellectual property.
Disputes
This agreement is governed by Texas law. If we disagree, we'll try mediation first, in Collin County, Texas, with the cost split evenly. If mediation hasn't resolved it within sixty days, either of us can take it to a court in Collin County, Texas.
Housekeeping
This document plus your invoice is the whole agreement, and it replaces anything said before it. Changes have to be in writing and agreed by both of us. If one part is found unenforceable, the rest stands. Neither of us can hand this agreement to someone else without the other's consent. We can refuse or end service to anyone, subject to section 9. Headings are for reading, not interpretation. We'll disclose information about a client to law enforcement on a lawful request.
12Agreement
Paying the setup invoice, or the first month of a plan, means you've read this and agree to it. We'll send you a copy with your first invoice and keep the current version at this address.
